Terms and Conditions
Effective Date: 20 August 2026

These Terms and Conditions govern the use of GetCleared.co.za and the purchase of document facilitation services provided by Moto Digital Solutions (Pty) Ltd (Reg. No. 2021/522062/07).

By using our website, requesting a quotation, making payment or instructing GetCleared to provide services, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

1. About GetCleared
GetCleared.co.za is a private document facilitation and consulting service.

We assist clients with the preparation, submission, follow-up and collection of official documents and applications, including:
- South African Police Clearance Certificates through SAPS;
- Urgent Police Clearance facilitation;
- DIRCO Apostille facilitation;
- Document authentication and legalisation;
- Criminal Record Expungement application facilitation;
- Supporting document assessment and preparation; and
- Document collection and courier delivery.

GetCleared is not a government department and is not affiliated with, owned by or operated by SAPS, DIRCO or any other South African government department.Official government forms may be available directly from the relevant government authority.

2. Our Role
GetCleared provides a professional facilitation service.Our role may include assessing documents, providing application guidance, preparing submissions, physically submitting documents, following up with relevant authorities, collecting completed documents and arranging delivery.

The final decision to issue, reject, approve, authenticate, apostille, expunge or otherwise process a document rests with the relevant government authority, court or competent institution.We cannot override or guarantee the decisions of these authorities.

3. Client Responsibilities
The client is responsible for ensuring that all information and documents supplied to GetCleared are accurate, complete, authentic and current.
The client must:
- Provide accurate personal information;
- Provide valid identification documents;
- Complete required forms correctly;
- Provide acceptable fingerprint documentation where required;
- Respond promptly to requests for additional information;
- Ensure that documents supplied are genuine;
- Provide correct courier and delivery details; and
- Notify GetCleared of any changes that may affect the application.

GetCleared is not responsible for delays or unsuccessful applications resulting from incorrect, incomplete, misleading or fraudulent information supplied by the client.

4. Turnaround Times
Our expedited services are designed to reduce the time normally associated with government document processing.Where a turnaround period is stated, it generally begins once:
1. Payment has been received;
2. All required documents have been received;
3. Documents have been reviewed and accepted as suitable for submission; and
4. Any required physical documents have reached our designated processing location.

Unless otherwise stated in writing, our expedited processing target is generally 7 to 10 working days for the relevant facilitation process.Turnaround times are estimates and are not an unconditional guarantee of government processing times.

Public holidays, government closures, system outages, additional verification, backlogs, strikes, courier delays, incorrect documentation and other circumstances outside our reasonable control may affect turnaround times.

5. Government Authorities
GetCleared facilitates applications but does not control SAPS, DIRCO, courts, embassies, government departments or other third-party authorities.

Accordingly, we cannot guarantee:
- The approval or outcome of an application;
- The absence of a criminal record;
- The exact date on which a government authority will issue a document;
- The acceptance of a document by a foreign government, embassy, employer, university or other institution; or
- The specific requirements imposed by an overseas authority.

Clients should independently confirm the document requirements of the organisation or authority requesting their documents.

6. Police Clearance Certificates
A South African Police Clearance Certificate is issued by the South African Police Service.GetCleared facilitates the application process, including document assessment, submission, follow-up and collection where applicable.

The existence or absence of a criminal record is determined solely by SAPS. GetCleared does not influence or alter the contents of a Police Clearance Certificate.

7. Apostille and Authentication Services
GetCleared assists with the facilitation of Apostille and authentication processes through the relevant authorities.

Whether a document requires an Apostille, authentication, legalisation, embassy attestation or another certification depends on the requirements of the destination country and the organisation requesting the document.

Clients remain responsible for confirming the specific requirements applicable to their intended use of the document.

8. Criminal Record Expungement
GetCleared may assist with the administrative facilitation of Criminal Record Expungement applications.Eligibility for expungement and the final outcome of an application are determined by the relevant legal and government authorities.Payment for facilitation does not guarantee that an application qualifies for expungement or that the application will be successful.Where legal advice is required, clients may be referred to or advised to consult an appropriately qualified legal professional.

9. Fees and Payment
All service fees must be paid in accordance with the quotation, invoice or payment instructions provided to the client.A quotation may include professional facilitation fees, government charges, courier charges, payment processing charges or other applicable costs.Unless expressly stated otherwise, third-party charges are separate from GetCleared's professional facilitation fee.GetCleared reserves the right to suspend work on an application where payment has not been received or where an outstanding balance remains due.

10. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms and Conditions.A refund is not automatically available simply because a government authority takes longer than expected to process an application or because an application does not produce the outcome requested by the client.Where a significant delay is caused by circumstances within GetCleared's control, we will communicate the delay and may offer an appropriate partial refund or other reasonable remedy in accordance with our Refund Policy.

11. Courier and Delivery
Where courier delivery is requested, GetCleared may arrange delivery through an independent courier provider.

The client is responsible for providing a complete and accurate delivery address and contact details.

Courier delivery times are estimates and may be affected by customs, international clearance, weather, operational disruptions, incorrect addresses, failed delivery attempts and other circumstances outside our control.

Additional courier charges may apply where a shipment must be redirected, reattempted or resent due to information supplied incorrectly by the client.

12. Digital Copies
Where a digital copy of a completed document is provided, it is supplied for convenience.The client is responsible for confirming whether a digital copy is acceptable to the organisation, employer, university, embassy, immigration authority or other institution requiring the document.

13. Document Security and Confidentiality
We understand that our clients entrust us with sensitive personal documents.We take reasonable steps to protect documents and personal information during the facilitation process. Our handling of personal information is further described in our Privacy Policy.Clients should only provide documents that are reasonably required for the service being requested.

14. Prohibited and Fraudulent Use
Clients may not use GetCleared's services for fraudulent, unlawful or misleading purposes.We reserve the right to refuse or terminate a service where we reasonably suspect fraud, document forgery, identity theft, unlawful activity or misuse of our services.Where appropriate, information may be reported to the relevant authorities.

15. Limitation of Liability
To the extent permitted by applicable law, GetCleared will not be liable for losses arising from circumstances outside our reasonable control, including government delays, government decisions, third-party failures, courier delays, system outages, incorrect client information or changes to government procedures.Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

16. No Guarantee of External Acceptance
GetCleared does not guarantee that a document will be accepted by a particular embassy, immigration authority, employer, university, court or other organisation.Document requirements vary between countries and institutions and may change without notice.Clients are responsible for confirming the requirements of the authority or institution for which the document is intended.

17. Website Content
We make reasonable efforts to ensure that information published on GetCleared.co.za is accurate and current.However, government procedures, fees, processing times and document requirements may change.Website content should therefore be regarded as general information and not as a substitute for confirmation from the relevant government authority.

18. Intellectual Property
Unless otherwise stated, the content of GetCleared.co.za, including its text, graphics, branding, logos, layouts and other materials, belongs to or is licensed to GetCleared or Moto Digital Solutions (Pty) Ltd.Website content may not be copied, reproduced, republished, modified or commercially exploited without prior written permission.

19. Privacy
The collection and handling of personal information is governed by our Privacy Policy and applicable South African privacy legislation, including POPIA where applicable.By using our services, you acknowledge that certain personal information and documents must be processed in order for us to provide the requested service.

20. Changes to These Terms
GetCleared may update these Terms and Conditions from time to time.The latest version published on the website will apply to services requested after the updated terms become effective.

21. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.Any dispute arising from the use of our services will be subject to the applicable jurisdiction of the South African courts, subject to any mandatory rights or protections available to the client under applicable law.
